APPROVAL OF THE REGULATIONS ON INSTALLATION AND OPERATION OF STORAGE FACILITIES

Please be advised that by means of Regulation No. 1/2016, of 2 March 2016, the Autoridade Nacional do Petróleo (now, the Autoridade Nacional do Petróleo e Minerais - ANPM) recently approved the Regulations on Installation and Operation of Storage Facilities, which entered into force on 3 march 2016.

 

The new rules set forth the terms and conditions applicable to the design, construction, installation, modification, maintenance, operation and decommissioning of storage facilities for fuels and products used in fuel blending in the territory of Timor-Leste, and apply to all storage facilities for fuels installed or to be installed in the country, irrespective of the nationality and nature of the entities that own or operate them.

In addition to the above, the Regulations set forth a special regime applicable to all storage facilities existing on the effective date of the Regulations, which shall have a period of up to 7 years to bring their facilities, equipment and operations in line with the rules and specifications of the statute.

Finally, this statute also includes the licensing fees applicable, as well as the penalties for breach of its provisions, which may amount to USD 1,000,000.
