CONSTRUCTION INDUSTRY AND PUBLIC WORKS SUBJECT TO NEW REGULATIONS ALREADY IN FORCE

Presidential Decree No. 63/16, of 29 March, 2016 approved the new regulations on (a) the construction industry, (b) public works, (c) construction projects and (d) works supervision.

 

This new statute establishes the licensing requirements for the performance of said activities, which vary depending on the type of works and activities envisaged, regulates the licensing process, including documents and data that must be submitted, also setting out the fines applicable in case of infringement. The statute also regulates the requirements of private works agreements subject to municipal licensing.

 

The new regulations entered into force on the date of publication, 29 March 2016, and are applicable to pending applications, which must be adjusted to match the new requirements, within 30 days. Existing licenses shall need to be replaced within 2 years from the date of its entry into force.
