MORE RESTRICTIVE ADVERTISING CODE ENTERS INTO FORCE THIS NOVEMBER

A new Advertising Code was approved by Decree No. 37/2016, of 31 August 2016. The Code will enter into force on 9 November 2016, and it expressly revokes the current Advertising Code, approved by Decree No 65/2004, of 31 December 2004.

 

The statute sets new restrictions on advertising, in particular with regard to the following areas:

 

  • Drugs, tobacco and tobacco products;
  • Employment opportunities;
  • Sale and lease of real estate;
  • Financial services and products;
  • Investments, loans and capital markets;
  • Trade; and
  • Food products.

 

The new Code also deals with the liability regime on advertising, and sets new principles to be observed in the advertising activity, notably the protection of copyright and related rights. Finally, the new statute regulates non-solicited advertising and direct marketing.
