The Timor-Leste Government just published Government Resolution no. 15/2020, dated 3 June 2020, which reserves for the National Oil Company, TIMOR GAP, E.P., a maximum 20% participating interest in all production sharing contracts (PSCs) awarded as a result of the ongoing oil & gas licensing round.

Effects of the Declaration of the State of Emergency in Timor-Leste
During the last 3 days, the National Parliament has passed a set of legislation approving the declaration of a nation-wide State of Emergency and the restriction measures that shall apply during the same. Among other statutes, the Parliament approved (i) Presidential Decree No. 29/2020, of 27 March 2020, declaring the State of Emergency for 30 days (from 28 March to 26 April), in order to prevent COVID-19 from further spreading among the population; and (ii) Government Decree No. 3/2020, of 28 March 2020, which enacts the Execution Rules applicable during the State of Emergency. Due to their practical implications, we would like to point out the following restrictive measures:

Timor-Leste announces Oil & Gas Licensing Round
The Timor-Leste Prime-Minister and the National Petroleum and Minerals Authority have today announced, at the first Timor-Leste Oil & Gas Summit, the opening of the country’s second oil & gas licensing round. There is plenty of highly prospective acreage on offer, with 18 blocks, 7 onshore and 11 offshore, including areas previously included in the Joint Petroleum Development Area.

Please be advised that, by means of Law No. 13/2017, of 5 June 2017, the National Parliament of Timor-Leste approved the special rules for the definition of immovable property ownership rights, which enters into force on 3 September 2017.

NEW COMPANIES’ LAW PUBLISHED
A new Companies’ Law was recently published by means of Law No. 10/2017, of 17 May 2017, which expressly revokes the prior framework approved by Law No. 4/2004, of 21 April 2004. The new Law will become effective 120 days after the date of publication.
